Legal Battle Over THCa Testing and Hemp Regulations

The ruling follows a lawsuit filed by the Tennessee Growers Coalition and the Tennessee Healthy Alternatives Association, who argued that the new regulations contradicted the 2023 hemp bill, which only regulates delta-9 THC levels. These new rules would have restricted THCa, a non-intoxicating compound that is a precursor to THC, effectively banning products that make up a significant portion of the market.

The injunction is a temporary win for the Tennessee hemp industry, which has generated between $280 and $560 million in retail sales and provided thousands of jobs. The court’s decision preserves the status quo until further testimony and data can be presented regarding the proposed testing methods for hemp products.

Impact on Tennessee’s Hemp Retailers

Retailers like Anna Butler of Hemp Trails in Memphis, who had already stopped stocking THCa products due to the uncertainty, are now cautiously optimistic. Others, like Elisha Millan of Grass Roots Dispensary in Chattanooga, fear that banning smokable hemp would send customers back to the black market.

“We want to make sure that adults who responsibly use hemp products have access to what they need,” said Millan, whose business relies on THCa flower for about 85% of its retail sales. She also emphasized the importance of protecting CBD flower and other hemp products that are crucial for many veterans and medical users.

While the legal battle is ongoing, the Tennessee hemp industry has some breathing room. With the February 18 deadline for the injunction approaching, there will be time for lawmakers to clarify regulations, ensuring that Tennessee’s hemp businesses can continue to thrive.
